General terms and conditions of sale and subscription

 

1. PREAMBLE

On the one hand, BBJ France – BBJ (Baby Journal) (hereinafter referred to as “The site”), whose registered office is located in Paris (75009), registered under SIRET number 909 and reachable by email at the following address: hello@baby-journal.com.

All orders placed on the site are subject to these general terms and conditions of sale. BBJ (Baby Journal) reserves the right to adapt or amend the general terms and conditions of sale at any time, so they should be re-read on each visit to the site. The version applicable to any transaction is the one published online at www.baby-journal.com at the time of the order. We consider that by validating your order, you accept our general terms and conditions of sale without reservation, having read them.

BBJ (Baby Journal) undertakes to comply with all the provisions of the French Consumer Code relating to distance selling.

2. THE CUSTOMER

The Customer declares that they are a natural person, at least 18 years of age, and have legal capacity or hold parental authorisation allowing them to place an order on the site.

When registering the Customer’s personal data in the “my account” section, the Customer must ensure that the mandatory data provided is accurate and complete. In the event of an error in the recipient’s details, BBJ (Baby Journal) cannot be held liable for any inability to deliver the product. BBJ (Baby Journal) reserves the right to cancel any order where the customer’s IP address is located in a country different from the billing and/or delivery address.

3. PRODUCTS

The characteristics of the products offered for sale are presented in the ” Our Journals ” section of our site. The photographs and descriptions of the products are as faithful as possible but cannot guarantee a perfect likeness to the product. However, should any errors or omissions occur in this presentation, “BBJ (Baby Journal) ” cannot be held liable. The photographs and texts illustrating the products are not contractual.

All texts and images presented on the “BBJ (Baby Journal) ” site are reserved worldwide under copyright and intellectual property law; their reproduction, even in part, is strictly prohibited.

4. ORDERS

Placing an order on the Site is subject to compliance with the procedure put in place by BBJ (Baby Journal), consisting of a series of steps that the Customer must follow in order to validate their order. Before finally validating the order, the customer will have the opportunity to check its details and total price, and to correct any errors, in particular regarding the delivery address, before confirming it to express acceptance. Any order confirmed by the Customer constitutes a contract of sale and acceptance of these terms.

“BBJ (Baby Journal) ” will refuse any order from a customer with whom there is a dispute or an incident relating to payment for a previous order, or which contravenes the provisions hereof.

In such a case, “BBJ (Baby Journal) ” will inform the Customer by email. Should the customer fail to correct, with “BBJ (Baby Journal) ”, the elements that are erroneous or contrary to these general terms and conditions of sale, “BBJ (Baby Journal) ” reserves the right not to process the order.

“BBJ (Baby Journal) ” undertakes to send a confirmation email summarising the order (products, price, quantity, discounts, etc.) to the email address provided at the time of the order. To this end, the Customer formally accepts the use of email for confirmation by “BBJ (Baby Journal) ” of the content of their order.

5. PAYMENT

Users may place an order on this site and may pay by bank card ((Carte Bleue, Visa, MasterCard, American Express) dispatch after receipt of payment), by cheque (dispatch after the payment has cleared) and by Paypal transfer. Bank card payments are made through secure transactions provided by the service provider: Paypal or another equivalent provider. The publisher of this site has no access to any data relating to the user’s means of payment. Payment is made directly to the banking institution.

6. DELIVERY

Orders are delivered by our couriers or by a third-party company in mainland France, in the French overseas departments and territories and throughout Europe. Dispatch takes place according to the order placed, once the price corresponding to the seller’s consideration has been fully received. In the event of an unusual delay in processing the products, an email will be sent to you.

The product is delivered to the billing address unless otherwise stated in the fields provided for this purpose when placing the order.

The user may not claim compensation in the event of a delay in delivery by the courier. Furthermore, in the event of an anomaly on receipt (damaged or opened bag, etc.), the user must submit their claim on the Site within 2 working days, principally by email or by registered post, a copy of which will be forwarded to “BBJ (Baby Journal) ”. If the user is present at the time of delivery, they must notify the courier of any reservations. These delivery issues are to be resolved primarily with the courier; “BBJ (Baby Journal) ” cannot be held liable for them.

Goods always travel at the recipient’s own risk.

In the event of an incomplete or incorrect delivery address provided by the customer, the new dispatch will be invoiced in addition to the order.

That said, despite all the care taken by “BBJ (Baby Journal) ” in preparing parcels, a product may be missing.

Likewise, after the parcel has been transported, one of the products may prove to be defective.

For this reason, on receipt of the order, the customer should check that the products received are as expected.

“BBJ (Baby Journal) ” reserves the right to modify at any time the list of countries or zones from which orders are accepted.

Order tracking: You can track the progress of your order in real time in the « my account » section of the “BBJ (Baby Journal) ” site.

There are 3 order statuses:

  • “payment accepted” Your order is awaiting preparation.
  • “preparation in progress” Your order is being prepared.
  • “order dispatched” Your parcel has left our premises and is being delivered.

Claims: For any claim, we invite you to contact our departments. All claims relating to a defect in the goods delivered, to an inaccuracy in the quantities or to an incorrect reference compared with the accepted offer or with the order confirmation by baby-journal.com, must be submitted to baby-journal.com by email no later than one day after receipt of the parcel: hello@baby-journal.com.

Once return approval has been obtained, the buyer has fourteen days to return the defective goods to BBJ – baby-journal.com. After verification and acceptance of your return, a refund will be issued within 48 hours of receipt of the defective item.

7. RETURNS, WITHDRAWAL AND REFUNDS

The Customer has a period of fourteen clear days in which to exercise their right of withdrawal, without having to give reasons or pay penalties with the exception of return costs, from delivery of the order, exercised by returning the products at their own expense as they are, together with the order number, to the following address:

Where the fourteen-day period expires on a Saturday, a Sunday or a public or non-working holiday, it is extended until the following first working day. Products returned incomplete, damaged or soiled by the buyer will not be accepted.

Refunds for products will be issued within a maximum of 30 days after receipt of the said products. The refund will be made using the same payment method chosen by the customer at the time of their order.

9. LIMITED LIABILITY

“BBJ (Baby Journal) ”, in the online sales process, is bound only by an obligation of means; it cannot be held liable for any damage resulting from the use of the Internet such as loss of data, intrusion, viruses, interruption of service, or other involuntary problems.

The photographs, texts or characteristics illustrating the products are not contractual and cannot therefore engage the liability of “BBJ (Baby Journal) ”

The liability of “BBJ (Baby Journal) ” in respect of the sale of products towards the buyer is in any event limited to the amount paid by the buyer.

The liability of “BBJ (Baby Journal) ” cannot be invoked for the non-performance of a contract in the event of the unavailability of a product, or of force majeure as customarily recognised by French case law.

10. INTELLECTUAL PROPERTY

All elements of the site, whether visual or audio, including the underlying technology, are protected by copyright, trademark or patent law. They are the exclusive property of BBJ (Baby Journal) .

A user who has a personal website and who wishes to place on it, for personal use, a simple link pointing directly to the Site’s homepage must first request authorisation from “BBJ (Baby Journal) ”.

Conversely, any hypertext link pointing to the Site and using framing or in-line linking techniques is strictly prohibited. In all cases, any link, even tacitly authorised, must be removed on simple request from “BBJ (Baby Journal) ”.

Hypertext links may point to sites other than the site. “BBJ (Baby Journal) ” accepts no liability in the event that the content of those sites contravenes the laws and regulations in force.

11. PARTIAL INVALIDITY

In the event that one of the clauses of this contract becomes null and void through a change in legislation or regulation, or by a court decision, this shall in no way affect the validity of and compliance with these general terms and conditions of sale.
